Welcome to ResiPark! Please read these Terms of Service (“Terms”) carefully before using our website and services. By accessing or using ResiPark.ca (the “Platform”), you agree to be bound by these Terms.
1. About ResiPark
ResiPark is a third-party platform that connects individuals who have unused driveway space (“Hosts”) with those seeking parking (“Guests”). ResiPark is not a parking operator and does not own, manage, lease, or control any of the parking spaces listed on the Platform.
2. Eligibility
To use ResiPark, you must be at least 18 years old and capable of entering into legally binding agreements. By using the Platform, you represent and warrant that you meet these requirements.
3. Account Registration
Users must create an account to list or book parking. You agree to provide accurate, current, and complete information during the registration process and to keep your information updated. You are responsible for maintaining the confidentiality of your account credentials.
4. Platform Use and Conduct
You agree to use the Platform for lawful purposes only. You must not:
- Violate any laws or regulations
- Post false, misleading, or fraudulent listings
- Damage or interfere with any part of the Platform
5. Financial Transactions
ResiPark does not process payments or collect fees on behalf of Hosts or Guests. All payment terms and transactions are arranged directly between Hosts and Guests. ResiPark is not a party to any financial agreement or dispute.
6. Third-Party Responsibility & Disclaimer
ResiPark acts only as an intermediary to connect Hosts and Guests. We do not:
- Inspect or verify any parking location
- Guarantee the availability, safety, legality, or quality of any parking space
- Assume responsibility for any damage, theft, injury, or disputes arising from parking arrangements
7. Indemnification
You agree to indemnify, defend, and hold harmless ResiPark, its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or in any way connected with:
- Your access to or use of the Platform
- Your listing or booking of a parking space
- Your violation of these Terms or any applicable law
- Your interaction or agreement with another user
8. Limitation of Liability
To the fullest extent permitted by law, ResiPark shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Platform, including parking-related disputes or issues.
9. Termination
ResiPark may terminate or suspend your account at any time and without notice if we believe you have violated these Terms or misused the Platform.
10. Modifications to the Terms
We reserve the right to update or modify these Terms at any time. Changes will be effective upon posting. Continued use of the Platform after changes constitutes acceptance of the new Terms.
